The Courts have approved the "partial" settlement of the economic loss claims in the Canada-wide class actions called Morel v. Koninklijke Philips N.V. et al Action No. S216008 and Roy v. Respironics Inc. et al., No. 500-06-001154-216.

If there is no appeal submitted by the defendants, we will post the court-approved Approval Notice on this website and on the respective websites of Class Counsel on November 7, 2025.

Background

A class action has been filed concerning Philips Respironics sleep apnea machines and ventilators. Millions of these products, recalled by Philips in the United States on June 14, 2021 and by Health Canada on June 23, 2021, were manufactured with a Polyester-Based Polyurethane (PE-PUR) foam. This foam can degrade into toxic particles that users may inhale or ingest, potentially causing serious health issues such as cancer, respiratory damage, inflammation, nausea, and headaches.

The class action focuses on CPAP, BiPAP, and mechanical ventilator devices marketed by Philips and related companies.
